About these terms

The C Curl, also referred to as “we,” “us” or “our,” operates this website and offers the products, information and services available through it. Our store is powered by Shopify, which provides the ecommerce platform that allows us to sell our products to you.

These Terms of Service apply to all site visitors and customers. Our Privacy Policy, Shipping Policy, Return Policy, subscription terms and any other policies posted on the site are incorporated into these terms by reference.

Eligibility + acceptable use

You must be at least the age of majority in your state of residence to purchase from the site, or have the permission and supervision of a parent or legal guardian. You may use the site only for lawful personal purposes and may not use our products or services in violation of applicable law.

You may not interfere with the security or operation of the site, introduce malicious code, attempt to gain unauthorized access, collect information about other users, scrape or copy site content, or use the site for fraudulent, abusive or unlawful activity.

Accounts

If you create an account, you agree to provide current and accurate information and to keep your login credentials confidential. You are responsible for activity that occurs through your account. Please notify Customer Care promptly if you believe your account has been accessed without permission.

Site information + service changes

We make reasonable efforts to keep site information accurate, complete and current, but errors or omissions may occur. Historical information is provided for reference only. We may correct errors, update content, add or remove features, suspend portions of the service or discontinue products as permitted by law.

Payment card information is encrypted during transfer over networks. Other content you submit may be transmitted across networks and adapted to technical requirements. You agree not to reproduce, sell, resell or exploit any portion of the service or access to it without our written permission.

Product information

We take care to present product descriptions, photographs, colors and details accurately. Screen settings, lighting and other factors may affect how colors and finishes appear. Product packaging, ingredients, specifications and availability may change when appropriate, subject to applicable law.

Information on the site is provided for general educational and cosmetic purposes. It is not medical advice and is not a substitute for guidance from a qualified healthcare professional.

Prices + availability

Prices, promotions and product availability may change without notice. Taxes, shipping charges and other applicable fees are shown at checkout. If a product is listed with an incorrect price or other material error, we may correct the error, decline or cancel the affected order and refund any amount charged.

Orders

An order confirmation acknowledges that we received your order. It does not mean the order has been accepted. We may refuse, limit or cancel an order before shipment for reasons including product availability, suspected fraud, payment issues, pricing or listing errors, unusually large quantities, address concerns or suspected resale.

You agree to provide complete and accurate billing, payment, contact and shipping information and to keep account and payment details current. If we change or cancel an order, we may contact you using the email address or telephone number supplied with the order. If we cancel an order after payment has been processed, we will issue a refund to the original payment method. Products are offered for personal use and not for unauthorized resale.

Shipping + risk of loss

Processing and delivery estimates are provided in our Shipping Policy. They are estimates rather than guarantees. Carrier delays and events outside our reasonable control may affect delivery. Please review the shipping address carefully before submitting an order. If an address is incorrect, email support@theccurl.com within two hours after placing the order so we can try to help before fulfillment begins. We cannot guarantee a change after processing has started.

Returns + refunds

Returns and refunds are governed by our Return Policy, including eligibility, timing, return postage and any identified final sale items. Original shipping charges are not refundable unless the return resulted from our error. Approved refunds are credited to the original form of payment.

Six month tool guarantee

Beauty tools purchased directly from The C Curl may be eligible for review for a manufacturing defect for six months from the purchase date. Proof of purchase and photographs may be requested. If a covered manufacturing defect is confirmed, The C Curl may replace the tool at its discretion.

The guarantee does not cover normal wear, cosmetic changes that do not affect performance, worn or compressed pads, accidental damage, misuse, improper storage, unauthorized modification, loss, theft or products purchased from an unauthorized seller. This guarantee is in addition to rights that cannot be excluded under applicable law.

Subscriptions

If you enroll in a subscription, you authorize recurring charges to your selected payment method at the price and frequency disclosed when you subscribe, until the subscription is canceled. Applicable taxes and shipping charges may also apply.

You may manage or cancel a subscription through the customer portal or by contacting Customer Care, subject to the timing disclosed at enrollment. We will provide notices and obtain consent as required by applicable law. Canceling a subscription does not automatically cancel an order that has already been processed or shipped.

Promotions + discount codes

Promotions, gifts with purchase, bundles and discount codes are subject to the terms presented with the offer. Unless stated otherwise, offers cannot be combined, have no cash value, may be limited to one per customer or order, and may be changed or ended as permitted by law. We may cancel orders involving misuse, duplication or manipulation of an offer.

Product use + safety

Use products only as directed and discontinue use if irritation, discomfort or an unexpected reaction occurs. Keep beauty tools clean and inspect them before use. Replace worn pads as recommended and do not use a damaged tool. Avoid forcing, tugging or using the curler in a manner inconsistent with our instructions.

Ingredient sensitivities and individual results vary. Review product information before use and consult a healthcare professional when appropriate.

Intellectual property

The site and its content, including The C Curl name, trademarks, patented designs, product designs, text, photographs, videos, graphics, logos and other materials, are owned by or licensed to The C Curl and are protected by intellectual property laws.

We grant you a limited, personal, revocable and nontransferable right to access and use the site for lawful shopping and informational purposes. You may not reproduce, distribute, modify, sell, license, reverse engineer, create derivative works from or commercially exploit our site, content or products without prior written permission.

Reviews + submitted content

If you submit a review, photograph, video, comment, suggestion or other content, you confirm that you have the right to share it and that it is accurate, lawful and does not violate another person’s rights. You grant The C Curl a worldwide, nonexclusive, royalty free license to use, reproduce, adapt, publish and display that content in connection with our business, subject to applicable law and any separate agreement.

We may moderate or remove submitted content that is unlawful, misleading, abusive, infringing, unrelated or otherwise inappropriate. We are not obligated to publish or retain any submission.

Third party services + links

The site may include tools, payment services, applications or links provided by third parties. Their services are governed by their own terms and privacy practices. We are not responsible for third party content, availability or practices, except to the extent required by law.

Privacy + communications

Our collection and use of personal information is described in our Privacy Policy and related privacy notices. If you choose to receive marketing email or text messages, you may opt out using the method provided in the communication. Consent to marketing is not a condition of purchase. Transactional messages concerning an account, order or subscription may still be sent when permitted by law.

Disclaimer of warranties

Except for any express guarantee stated on the site and rights that cannot be excluded by law, the site, services and products are provided on an “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose and noninfringement. We do not promise that the site will always be uninterrupted, secure or error free.

Limitation of liability

To the fullest extent permitted by law, The C Curl and its owners, officers, employees, affiliates, service providers and licensors will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or business opportunity arising from use of the site, services or products.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless The C Curl and its affiliates, owners, officers, employees and service providers from claims, losses, liabilities and reasonable expenses arising from your unlawful use of the site, violation of these terms or infringement of another person’s rights.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute will be brought in a court with appropriate jurisdiction in Los Angeles County, California, unless applicable law gives you the right to bring it elsewhere.

Changes to these terms

We may revise these terms when needed. The current version and its updated date will always appear on this page. Your continued use of the site after revised terms take effect means you accept those terms.

Termination

These terms remain effective until ended by you or us. You may end them by ceasing use of the site. We may suspend or terminate access if we reasonably believe these terms have been violated. Amounts owed and obligations incurred before termination remain due, and provisions that by their nature should survive will continue to apply.

General provisions

If a provision of these terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. We may assign these terms in connection with a merger, sale, reorganization or transfer of our business. You may not assign your rights or obligations without our written consent.

These terms and the policies incorporated by reference form the entire agreement between you and The C Curl concerning the site and services and replace prior understandings on the same subject. Section headings are provided for convenience and do not limit the terms.
